From now on, provide a TARIC code in the customs declaration for products subject to REACH import control

If an importer imports products with commodity codes that indicate a restriction in accordance with Annex XVII to the REACH Regulation, a TARIC code must, from now on, be provided in the customs declaration. These products include, for example, food supplements, shampoos and chemicals.

REACH import control is based on Regulation (EC) No 1907/2006 of the European Parliament and of the Council concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH Regulation). The aim of the Regulation is to ensure that substances manufactured, placed on the market or used shall not adversely affect human health or the environment.

Annex XVII to the Regulation lists the substances whose manufacture, placing on the market or use on their own, in a mixture or in an article is permitted only if the substance fulfils the conditions mentioned in the Annex. The restrictions have been available in the TARIC database and in the Fintaric service since 10 February 2023.

Exceptions: scientific research and cosmetic products

The restrictions do not apply to substances intended for scientific research and development. Annex XVII may specify the quantity of such substances that can be imported and whether they can be used for product and process orientated research and development.

Restrictions under the REACH Regulation imposed due to risks to human health are exceptionally not applied to cosmetic products.

The REACH import control restrictions also apply to imports of goods by private individuals.

Provide a TARIC code in the customs declaration

If you import products with commodity codes that are subject to REACH import control, you must provide one of the following TARIC codes in the customs declaration:

  • Y106 – Compliance with the REACH restrictions defined in Column 2 of Annex XVII of Regulation (EC) No 1907/2006
  • Y110 – Exemption from REACH restrictions by virtue of Article 67(1) and 67(2) of Regulation (EC) No 1907/2006
  • Y113 – Product not subjected to the provisions of Regulation (EC) No 1907/2006 (Annex XVII).

These codes are so-called negation codes used to notify Customs that the imported product fulfils the conditions of the restriction or that the import of the product is allowed e.g. due to an exception. 

How to select the correct TARIC code

The importer must check the TARIC database or the Fintaric service for the restriction concerned according to Annex XVII to the REACH Regulation and then check Annex XVII for the conditions applying to the import of the product. The appropriate TARIC code for the product must be selected accordingly:

  • The code Y106 is used when the product contains a substance mentioned in column 1 of Annex XVII and the product is a product referred to in column 2, i.e. it is covered by the restriction. Make sure that the product fulfils the conditions for import mentioned in column 2.
  • The code Y110 is used in the case of exceptions, i.e. when the product is intended for scientific research or development or when the product is a cosmetic product subject to an exception. Check the exceptions in Article 67 of the REACH Regulation and any specifications regarding them in the restrictions in Annex XVII.
  • The code Y113 is used when the product is not covered by the restrictions according to Annex XVII, i.e. when
    • the product does not contain substances mentioned in column 1 of Annex XVII
    • the product contains products mentioned in column 1 but it is not a product referred to in column 2
    • the product is subject to an exception according to column 2.
