Quotas for certain fertilisers from Russia (updated 11 July)

Third paragraph updated on 11 July: the second commodity code has been changed to 3105 90 80 (the incorrect commodity code was 3105 90 20 80).

The European Union’s fifth sanctions package (regulation 2022/576, EOJ L 111/8.4.2022) includes, among other measures, restrictions on imports. From 10 July 2022, certain fertilisers may be imported from Russia only under two annual quotas.

The quota with order number 098250 covers 837 570 metric tonnes of potassium chloride of CN code 3104 20. The quota with order number 098251 covers 1 577 807 metric tonnes of mineral and chemical fertilisers of CN codes 3105 20, 3105 60 and 3105 90. The quotas are administered on a first come first served basis, and tariff quota claims are made on a customs declaration.

The import ban and quotas do not apply to fertilisers of CN codes 3105 90 20 and 3105 90 80 which do not contain potassium chloride.

Since imports outside of the quota are prohibited, the goods can be released for free circulation only once the Commission has accepted the quota request. If the full requested quantity is not accepted into the quota, the share of goods left without the quota benefit must be re-exported or deposited in a customs warehouse. The goods can be moved under direct transit to another member state if there is still room in the quota when the transit procedure is opened. When the quota has been exhausted, it is prohibited to import the goods because of the sanctions. 

How to make a quota claim

When making a quota claim, provide the details in the import declaration as follows:

  • preferential treatment: 120
  • country of preferential origin: RU
  • additional information code FIPRE and ”120” as its description
  • when claiming quota 098250
    • in the Customs Clearance Service, select certificate code K020
    • in message declarations, provide the certificate code K020 as an additional document for the goods item
  • when claiming quota 098251
    • in the Customs Clearance Service, select certificate code K022
    • in message declarations, provide the certificate code K022 as an additional document for the goods item

If there is no room in the quota for the imported goods, you can deposit the goods in a customs warehouse and wait for a new quota to open. Provide the following details in the customs warehousing declaration:

  • if quota 098250 or 098251 was exhausted
    • with the additional information code FIXXX, provide the MRN of the import declaration with which you made the quota claim

How to declare goods not covered by the import ban

If you are importing fertilisers of CN codes 3105 90 20 and 3105 90 20 80 which do not contain potassium chloride, provide the following details in the customs declaration:   

  • preferential treatment code: 100
  • country of preferential origin: RU
  • negation code: Y835.
